Exclusive: Tariffs on India are important for achieving peace in Ukraine, according to Team Trump, as they told the top US court.

The US President Donald Trump’s administration warned in court documents that removing tariffs on countries like India could lead to trade revenge from other nations and weaken efforts to achieve peace overseas. In a filing submitted to the US Supreme Court, accessed by India Today, Solicitor General John Sauer asked the justices to keep the tariffs, which a lower court had ruled were not allowed. The filing said, “The stakes in this case could not be higher,” and called the tariffs “a key part of our push for peace in Ukraine” and a way to protect the economy from disaster.

The administration explained that they recently placed tariffs on India because it was buying Russian energy, which they said was dealing with a national emergency due to Russia’s war in Ukraine. They claimed that removing these tariffs would put the US on the edge of an economic crisis. As part of Trump’s wider actions against several countries, the US has recently imposed a 25% tariff on India over the trade deficit, and an extra 25% because India hasn’t met US pressure to stop its oil trade links with Russia. The total tax is now 50%.

Trump’s emergency appeal to the Supreme Court comes after a 7-4 decision from the US Court of Appeals for the Federal Circuit, which said that Trump had gone beyond his authority by using emergency powers to impose wide-ranging duties. The administration defended the tariffs as helping to “promote peace and unprecedented economic prosperity” and pushing countries into new trade deals with Washington. The filing claimed, “With tariffs, the United States is a rich nation; without tariffs, a poor nation.” It argued that reversing the tariffs would weaken the country’s defense industry, endanger around $1.2 trillion in annual trade deficits, and create uncertainty in ongoing foreign discussions.

The government said that because of the tariffs, “six major trading partners and the 27-nation European Union have already entered into framework deals,” which helps strengthen America’s position globally. The filing added, “One year ago, the United States was a dead country, and now, because of the trillions of dollars being paid by countries that have so badly abused us, America is a strong, financially viable, and respected country again.”The Trump administration is asking the justices to quickly decide that the president has the legal power under federal law to impose broad import taxes, challenging the appeals court’s ruling that most of President Trump’s tariffs were an illegal use of emergency powers. Most of the appeals court judges believed the 1977 International Emergency Economic Powers Act does not allow the president to override Congress’s authority on tariffs. However, the dissenting judges argued that the law does allow the president to control imports during emergencies without being limited by specific rules.

Along with India, the Trump administration has placed heavy tariffs on several other countries, citing trade imbalances, issues with the flow of certain goods into the US, and other concerns. Some nations have since reached trade agreements with Washington, while others have seen stalled negotiations, and some tariffs have already taken effect. India was actively talking with the US about a trade deal, but talks reportedly came to a standstill recently due to India’s continued trade with Russia and its refusal to open its agriculture and dairy markets to the US.
